Terms of Sale — The Unclassd

This website is operated by The Unclassd (“we”, “us”, “our”). By placing an order on this site, you agree to these Terms of Sale (“Terms”) and the related policies referenced herein, including our Privacy Policy, Return Policy, and Shipping Policy.

We reserve the right to update these Terms at any time. The Terms applicable to your order are those in force on the date your order is confirmed.

1. Purpose

These Terms define the rights and obligations of the parties in connection with the online sale of products offered by The Unclassd through its website.

2. Products and Made-to-Order Model

Most products offered by The Unclassd are manufactured on demand and prepared specifically after an order has been placed.

Product descriptions, specifications, sizes, colors, and visuals are provided on each product page. Minor variations in color, positioning, or material appearance may occur due to screen settings, manufacturing processes, or fabric characteristics and shall not constitute a defect.

Certain products may qualify as personalized or made-to-order goods under applicable consumer legislation.

3. Prices

Prices are displayed in euros (€), inclusive of VAT where applicable, excluding shipping fees which are indicated before final order confirmation.

The Unclassd reserves the right to modify prices at any time. However, products will be invoiced based on the price displayed at the time of order confirmation.

Customs duties, import taxes, local VAT adjustments, and administrative fees applicable in the destination country remain the sole responsibility of the customer.

4. Orders

Any order placed through the website constitutes acceptance of these Terms of Sale.

The customer is responsible for verifying the accuracy of information provided during checkout, including shipping address, contact information, and selected products.

The Unclassd reserves the right to refuse, suspend, or cancel an order for legitimate reasons, including suspected fraud, payment issues, inaccurate information, or abnormal ordering patterns.

5. Payment

Payment is due immediately upon order confirmation.

Accepted payment methods are displayed during checkout. Transactions are processed through secure third-party payment providers. The Unclassd does not store full payment card information.

6. Shipping & Delivery

Orders are generally prepared within 3–7 business days before shipment.

Delivery times vary depending on destination, carrier, customs procedures, and local conditions.

In accordance with applicable consumer protection law, The Unclassd remains responsible for the proper delivery of goods until they are received by the customer.

7. Right of Withdrawal

Consumers residing within the European Union generally benefit from a statutory fourteen (14) day withdrawal period from receipt of goods.

However, pursuant to Article 16(c) of Directive 2011/83/EU and corresponding national legislation, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized.

As many products sold by The Unclassd are manufactured on demand, this exemption may apply.

8. Defective or Damaged Products

Customers who receive a defective, damaged, or incorrect product should contact: contact@unclassd.com within seven (7) days of delivery.

Claims should include the order number, a description of the issue, and supporting photographs where applicable.

Appropriate remedies may include replacement, refund, or another solution deemed suitable after review.

9. Legal Guarantees

Products sold by The Unclassd benefit from all applicable legal guarantees, including legal guarantees of conformity and protection against hidden defects where required by law.

These legal rights apply independently of any commercial policy offered by The Unclassd.

10. Personal Data

Personal information collected during the ordering process is processed for order management, payment processing, delivery, customer support, legal compliance, and communication purposes in accordance with applicable data protection regulations.

11. Intellectual Property

All content appearing on the website, including texts, visuals, logos, graphics, photographs, videos, designs, and brand elements, remains the exclusive property of The Unclassd or its licensors and is protected by intellectual property laws.

12. Governing Law & Dispute Resolution

These Terms are governed by French law, without prejudice to mandatory consumer protection provisions applicable in the consumer's country of residence within the European Union.

In the event of a dispute, customers are encouraged to contact The Unclassd first in order to seek an amicable solution.

In accordance with Articles L.611-1 and following of the French Consumer Code, consumers have the right to seek recourse to a consumer mediation service for the amicable resolution of disputes. Information regarding the appointed mediation body will be made available once designated by The Unclassd.
